Zorbitz, Inc., a California corporation ("Corporation"), through our website www.blackstarbracelet.com (the "Website"), allows Visitors (as defined below) to purchase a product and, in connection therewith, receive a unique code ("User Code") which allows Members (as defined below) to download songs on the Website and exclusive gifts therefrom and provides other services directly related thereto (referred to hereafter as the "Service(s)"), subject to the following Terms of Use (the "Terms"), which may be updated by Corporation from time to time. Corporation will provide notice of materially significant changes to the Terms by posting notice of such changes on the Website.


By using the Service in any way you agree to be bound by the Terms as amended -- whether you simply browse the Website (a "Visitor") or have purchased a product and received a User Code there from (a "Member"). Indemnity

U.S. Export Controls


Software available in connection with the Services (the "Software") is further subject to United States export controls. No Software may be downloaded from the Website or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk.


Prizes


Any Prize won on the Website will be mailed or emailed to a User. Once the Prize is deposited in the mail by Corporation and addressed to a User, or the email containing a Prize is sent by Corporation to the email address provided by the User, the risk of loss shall be borne by the User. Corporation shall have no obligation to any User that wins a Prize with respect to any tax obligation any such User incurs as a result of or attributable to the Website or the Services. However, to receive a Prize does not require the purchase of a product. Instead, a User can simply mail a request, via certified mail return receipt requested, for a Prize. General Information


The Terms constitute the entire agreement between you and Corporation and govern your use of the Website and the Service, superseding any prior agreements between you and Corporation. The Terms and the relationship between you and Corporation shall be governed by the laws of the State of California without regard to any conflicts of laws principles. You and Corporation agree to submit to the exclusive jurisdiction of the courts located within the County of Los Angeles, State of California to resolve any dispute arising out of or related to the Terms or the Services. The failure of Corporation to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. The Terms do not limit any rights that Corporation may have under trade secret, copyright, patent or other laws. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms shall remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website, the Service or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. You also agree that the Terms shall not be construed against the drafting party, i.e., Corporation. EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION (INCLUDING BUT NOT LIMITED TO ANY CLAIMS, COUNTERCLAIMS, CROSS-CLAIMS, OR THIRD PARTY CLAIMS) ARISING OUT OF, UNDER OR IN CONNECTION WITH THESE TERMS. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS AGREEMENT

When purchasing a product from the Website, you will have five (5) business days from your date of receipt to return such product for a refund equal to the purchase price of such product less any shipping fees incurred by Corporation.

Privacy Policy

Information Collection and Use


Zorbitz, Inc., a California corporation (the "Corporation"), respects the privacy concerns of each visitor (a "Visitor") that simply browses www.wishingbracelet.com (the "Website") and each person that purchases a product from the Website (a "Member") (the term "User" refers to a Visitor, a Member, or, if the Visitor or Member is under the age of 18, the parents of such Visitor or Member). The parent's email address is correlated with the Child's user name.
We may also use email addresses and user names to enable parents to review the Personally Identifiable Information that his or her Child has submitted to the Website and to provide notification regarding the Website, such as any future amendments to this Privacy Policy. Under COPPA, a parent has the option to consent to the collection of his or her Child's Personally Identifiable Information without consenting to the disclosure of that information to third parties.
